That is the contradiction sitting at the heart of the Protect College Sports Act.

The U.S. Senate passed the legislation 77-22 Monday, sending it to the House of Representatives. Texas Sen. Ted Cruz and Washington Sen. Maria Cantwell have been among the bill’s principal architects.

The legislation contains legitimate benefits for college athletes, including scholarship protections, post-eligibility medical coverage, NIL rights, and safeguards against predatory agents.

But those benefits should not end the discussion about who carries the financial restrictions.

College athletes would operate under federally protected compensation rules that limit money flowing directly or indirectly from universities and affiliated organizations. Coaches would continue negotiating their compensation in the marketplace.

That distinction deserves scrutiny.

Different Markets, Same Football Game

Former Alabama coach Nick Saban defended the difference Tuesday during an appearance on ESPN’s First Take.

Saban argued that athletes and coaches operate in “different markets.” He compared the relationship to the difference between a student’s scholarship and a professor’s salary.

There is an obvious problem with that analogy. The quarterback is not sitting in Bryant-Denny Stadium taking notes while the coach generates the product. The quarterback is part of the product.

So are the running back, offensive linemen, defensive backs, receivers, kickers, and every other athlete whose performance creates the game television networks purchase, advertisers sponsor, ticket holders attend, and fans build their Saturdays around.

Coaches unquestionably create value. Great coaches recruit players, develop talent, build programs, attract donors, generate attention, and sometimes transform universities.

But college football cannot exist without football players. That should be obvious.

Tuscaloosa Shows the Economic Power

Consider Alabama. A University of Alabama economic-impact study examining 2019 found that visitors generated approximately $200 million for the Tuscaloosa metropolitan economy.

Seven Alabama home football games alone accounted for approximately $138 million of that impact — about $19.8 million per home game.

That money flowed through hotels, restaurants, stores, transportation providers, and other businesses because tens of thousands of people traveled to Tuscaloosa for Alabama football.

Nick Saban certainly helped build the powerhouse program those fans wanted to see. But nobody bought a ticket to watch Saban wear a headset. They came to watch the players play football.

Recognizing the enormous value of elite coaching should not require pretending the athletes on the field produce less economic value. Both groups contribute.

The disagreement is over why Congress should interfere with the compensation market for one group while leaving the other largely untouched.

Senators Tried to Cap Coaches

Sens. Cory Booker of New Jersey and Chris Murphy of Connecticut pushed that contradiction directly onto the Senate floor. A proposed amendment would have placed a $5 million annual limit on compensation for college coaches. The amendment failed, 47-52.

That vote may be one of the most revealing moments of the entire Protect College Sports Act debate. Congress was willing to advance legislation establishing significant controls over athlete compensation while rejecting an effort to impose a comparable ceiling on highly compensated coaches.

If compensation limits are necessary to preserve college athletics, why does that principle suddenly disappear when the paycheck belongs to the coach?

If free-market competition is appropriate for Nick Saban, Kirby Smart, Steve Sarkisian, Dan Lanning, and other elite coaches, lawmakers should be prepared to explain why athletes cannot make the same free-market argument.

That is the question.

Saban Offers Another Solution

Saban did raise a legitimate issue concerning coaching contracts. Instead of limiting salaries, he suggested addressing the length of coaching contracts and the enormous buyouts universities sometimes owe when they fire coaches. That deserves discussion.

College athletics has developed an extraordinary system in which a university can agree to pay millions of dollars to remove one coach, spend millions more hiring another, invest tens of millions in facilities, and participate in escalating conference television deals — while simultaneously arguing that unrestricted athlete compensation threatens the financial structure of college sports.

If runaway spending is the problem, lawmakers should examine runaway spending throughout the system.

Coaching salaries. Buyouts. Administrative salaries. Facilities. Recruiting operations. Conference offices. Media arrangements. And athlete compensation.

Singling out the athletes creates the appearance that financial discipline becomes urgent only when athletes receive the money.

This Is Not About Opposing Player Rules

College athletics does need rules.

The transfer portal cannot operate indefinitely without structure. NIL agreements should be legitimate commercial arrangements rather than disguised recruiting payments. Agents should face standards. Athletes deserve guaranteed scholarships, medical protection, and enforceable rights.

The Protect College Sports Act attempts to address several of those problems. But reasonable regulation does not make every provision reasonable. Lawmakers also need to confront what changed college sports in the first place.

For generations, universities, conferences, television networks, coaches, administrators, apparel companies, and surrounding communities built enormous businesses around college athletes.

The athletes finally gained greater access to the money their performances help generate. Now Congress is being asked to establish federal boundaries around that compensation.

The adults should not automatically receive an exemption from the same conversation.

What About the Free Market?

ESPN analyst Mina Kimes reduced the issue to a particularly important economic question after Saban’s appearance. If athletes really create less value than coaches, why wouldn’t universities be willing to let the marketplace determine their value?

That question gets directly to the contradiction. A free market does not guarantee that every quarterback becomes a millionaire.

It does not guarantee equal salaries. It does not guarantee that a backup offensive lineman earns what a Heisman Trophy candidate earns. It simply allows buyers and sellers to establish value.

College football has enthusiastically embraced that principle when bidding for coaches. Universities routinely compete against each other with salaries, bonuses, private-plane access, housing arrangements, retention bonuses, and multimillion-dollar buyout provisions.

Nobody seriously proposes telling an elite coach that he is making too much because his salary might disrupt competitive balance. But when athletes begin exercising greater economic leverage, competitive balance suddenly becomes a congressional concern.

That inconsistency is difficult to ignore.

The Players Have Leverage Now

There is another reality college sports leaders should consider. Players increasingly understand their economic importance. Without them, there is no Saturday afternoon television inventory.

There is no College Football Playoff. There are no conference championship games. There are no $100 jerseys. There are no sold-out stadiums. There are no multimillion-dollar coaching contracts. There is no college football industry.

College leaders should be careful about creating a system in which athletes eventually conclude that withholding their labor is the only leverage they have remaining.

Professional sports learned decades ago that disputes between ownership and players are ultimately resolved through negotiation.

College sports keeps searching for ways around that conversation. Maybe it is time to have it.

One Standard Should Be Enough

Supporters of the Protect College Sports Act argue that national rules are necessary to stabilize college athletics. They point to transfer instability, NIL disputes, litigation, escalating spending, and threats to women’s and Olympic sports.

Those concerns should be taken seriously. So should the concerns of the athletes generating much of the revenue.

Congress cannot convincingly celebrate free-market economics for coaches while treating those same market forces as dangerous when they benefit players.

Either uncontrolled compensation threatens college athletics or it doesn’t. Either market competition should determine economic value or Congress should explain why different standards are necessary.

College coaches have every right to earn what the market will pay them. College athletes deserve a serious explanation for why Congress believes they should be treated differently.

That is the debate lawmakers should have before the Protect College Sports Act becomes federal law.
